Tancredi & McMahon Oppose State Overreach That Threatens Local Zoning Laws

Bernards Township deserves to shape its own future — not have it dictated by Trenton. That’s why Township Committee candidates David Tancredi and Bill McMahon are strongly opposed to Senate Bill S1408 and Assembly Bill A2757, which would override our local zoning authority and force towns to allow mixed-use developments on designated commercial properties.
What the Bills Propose
These bills would authorize the conversion of certain office parks and retail centers — labeled as “stranded assets” — into mixed-use developments, even if the properties don’t align with a town’s master plan or existing zoning.
A “stranded asset” under this bill includes:
Office parks of at least 50,000 sq. ft. or retail centers of at least 15,000 sq. ft.
A vacancy rate of 25%+ for the past 18 months or a 30%+ revenue loss for each of the last three years
If passed, developers could bypass local planning standards to build residential units (with a 20% affordable housing requirement) and other non-industrial uses — even if the town’s zoning says otherwise.
Why It Matters for Bernards Township
This bill would override our master planning process, erode our local zoning protections, and open the door to developments that don’t match the character or needs of our community. It would also create confusion and costly legal battles by failing to establish clear criteria or development standards.
Worse, the legislation ignores the requirements of New Jersey’s Municipal Land Use Law, undermining decades of precedent in support of home rule.
